Welcome to Nami. These Terms of Service ("Terms") govern your use of the Nami mobile application, our website, and related services (the "Service"). By installing or using the app, or by subscribing on our website, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use Nami. If you are using the Service on behalf of an organization, you confirm you have authority to do so.

2. Your account

You are responsible for the activity on your account and for keeping your sign-in credentials confidential. Please notify us promptly if you suspect unauthorized access.

3. Acceptable use

• Do not use the Service to harm yourself or others.
• Do not attempt to interfere with or reverse engineer the app.
• Do not upload content that is unlawful, hateful, or infringes the rights of others.

4. Your content

You retain ownership of the photos, notes, and reflections you add to Nami. You grant us a limited license to store and display this content solely so we can operate the Service for you. We do not use your content to train machine-learning models.

5. Health disclaimer

Nami is a wellness tool, not a medical service. It is not a substitute for professional treatment for substance use disorder, mental health conditions, or any medical concern. If you are in distress, please contact a qualified health professional or your local emergency services.

6. Subscriptions and payments

Some features require a paid subscription to Nami Pro. How you are billed depends on where you subscribe.

On our website, you choose a monthly, three-month, or six-month plan. Payment is taken as soon as you confirm your purchase, and is processed by our payment provider, Stripe. The price and the billing period are shown to you before you confirm.

In the iOS or Android app, billing is handled by the Apple App Store or Google Play, on the terms of the offer shown to you at the time of purchase.

Subscriptions renew automatically for the same period, at the then-current price, until you cancel. You can cancel at any time; our Refund Policy explains how to cancel and how refunds work.

7. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or if we are required to do so by law.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Nami disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes a legal guarantee that applicable consumer law does not allow us to exclude.

9. Limitation of liability

To the maximum extent permitted by law, Nami will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Service.

10. Changes to these Terms

We may revise these Terms occasionally. If we make material changes, we will notify you in the app or by email. Continued use of the Service after changes take effect means you accept the revised Terms.

11. Governing law

These Terms are governed by the laws of France, without regard to its conflict-of-laws principles. Disputes will be resolved in the competent courts of Paris, France, unless mandatory consumer-protection law provides otherwise. If you are a consumer resident in the European Union, you keep the protection of the mandatory rules of the country you live in, and you may bring proceedings in the courts of that country.
